Certificates of Lawfulness Applications

A Certificate of Lawfulness demonstrates that an existing (or proposed) use of a property (such as for Short-Term Letting) is lawful.  Obtaining a Certificate of Lawfulness demonstrates that Planning Permission is required to continue (or instigate) the use and renders that use immune from Planning Enforcement Action.

Certificates are granted to the property, not the applicant, and properties benefiting from a Certificate may see a resulting increase in value.

Applications generally fall into two categories :-
  1. That the existing (or proposed) use does not constitute “development” (in its legal sense) and is therefore lawful.

  2. That the use has persisted for so long without attracting enforcement action, it has become lawful by operation of law.

Both arguments must be appropriate and carefully framed and it may be necessary to provide evidence of the length of time a property has been put to use.
